Same defendant. Same incident. Different charges.
Cody Borner pleaded not guilty to seven Class C felony charges Nov. 27 in relation to a Beulah apartment shooting almost two years ago. If found guilty on all counts he could spend up to 35 years in prison.
The hearings bring forth a second round charges against the Stanton man, who was allegedly involved in a shooting that left Michael Padilla, of Billings, Mont., dead. A Mercer County deputy took the stand at the preliminary hearing to present evidence, including graphic pictures of the crime scene.
Borner and Richard Whitman, Hazen, allegedly entered an apartment where Padilla and his family lived. The two allegedly entered the apartment to steal drugs, according to court documents.
Borner was allegedly wearing a mask when he struck Padilla with an AR-15. Court documents allege that Whitman shot and killed Michael Padilla. His brother, Timothy Padilla, was also shot and injured.
